The Vendor Disclosure Legislation in New South Wales requires any person selling property in this State to have a prepared Contract for Sale of Land complete with all necessary attachments.
If you instruct Step by Step Conveyancing Pty Ltd to act on your behalf, we will prepare Contract for Sale of Land and will have the following documents attached :-
(i) An official copy of the Title to your property together with the official Plan, Easements and Covenants, if any. These are obtained from the Land & Property Infomation Office.
(ii) A 149 Zoning Certificate under Section 149 (2) of the Environmental Planning and Assessment Act, 1979. This Certificate is obtained from the Local Council.
(iii) A Drainage Diagram showing the position of the sewer line.
STEP BY STEP'S FIVE EASY STEPS
STEP 1 Step by Step Conveyancing will prepare the Contract for Sale of Land, as per your instructions, including obtaining the relevant Certificates.
STEP 2 Step by Step Conveyancing will apply to the relevant authorites for all necessary certificates.
STEP 3 The Contract for Sale will be forwarded to your nominated Real Estate Agent electronically and three (3) hard copies via mail.
STEP 4 Your selling Agent will advertise your property.
STEP 5 Once a buyer has been found, Step by Step Conveyancing will arrange on your behalf the exchange of Contracts with the Purchaser. This is the time the Purchaser pays their 10% deposit and becomes binding to complete their purchase.
Alternatively the Real Estate agent exchanges Contracts on your behalf which will allow the Purchaser either a five (5) day or ten (10) business day Cooling Off period where they will pay a 0.25% deposit. This time allows the Purchaser to carry out their pre-purchase inspections such as Pest, Building or Strata Inspection Reports and obtain their unconditional finance approval. If the Purchaser decides to rescind the Contract during the Cooling Off period, the 0.25% deposit already paid will be forfeited to you by way of compensation for having the property off the market during that period. As soon as he Contract is binding on all parties we then arrange for completion of your sale (also known as the settlement process).
